1. Acceptance of Terms

By accessing or using Gleam ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part, you may not access the Service.

2. Description of Service

Gleam is a platform that enables creators to sell digital products online. We provide tools for product hosting, payment processing, download delivery, and EU legal compliance.

3. Account Registration

To use the Service as a seller, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

4. Seller Obligations

As a seller on Gleam, you agree to:

  • Only sell digital products you have the right to distribute
  • Provide accurate product descriptions
  • Deliver products as promised to buyers
  • Comply with all applicable laws and regulations
  • Handle customer support for your products
  • Not sell prohibited content (see Section 5)

5. Prohibited Content

You may not sell or distribute:

  • Illegal content or content that violates third-party rights
  • Malware, viruses, or harmful code
  • Adult content without proper age verification
  • Counterfeit or pirated materials
  • Content promoting violence, hatred, or discrimination
  • Personal data or private information of others

6. Fees and Payments

6.1 Pricing Plans

Gleam offers various pricing plans with different features and transaction fees. Current pricing is available on our website.

6.2 Transaction Fees

We charge a percentage fee on each transaction. The fee varies by plan and is deducted before payout. Stripe payment processing fees apply in addition.

6.3 Payouts

Payouts are processed through Stripe Connect. You must connect a valid Stripe account to receive payments. Payout timing depends on your Stripe account status.

7. Refunds

Our refund policy provides buyers with a 14-day money-back guarantee for digital products, in compliance with EU consumer protection laws. Sellers are responsible for processing legitimate refund requests.

8. Intellectual Property

You retain all rights to your content. By using the Service, you grant us a limited license to host, display, and distribute your products to buyers.

9. Tax Compliance

We automatically calculate and collect EU VAT on transactions where required. You are responsible for any additional tax obligations in your jurisdiction. We provide transaction reports to assist with your tax filings.

10. Termination

We may suspend or terminate your account for violations of these terms. You may close your account at any time. Upon termination, pending payouts will be processed according to our standard schedule.

11. Limitation of Liability

To the maximum extent permitted by law, Gleam shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Gleam from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Changes to Terms

We may modify these terms at any time. We will notify you of significant changes via email or platform notification. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Berlin, Germany.
